Terms of Use

Terms of Use for Translate Blue

Please read these Terms of Use ("Terms", "Terms of Use") carefully before using the Translate Blue application (the "Service"), including its iOS app, macOS app, and extensions such as Widget and Keyboard, operated by Translate Blue ("us", "we", or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service. You must be at least 13 years old to use the Service; if you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian who agrees to these Terms.

2. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Translate Blue and its licensors. The Service is protected by copyright, trademark, and other laws of Japan, the United States, and other countries.

2a. Third-Party Models and Components

The Service includes and can download machine-learning models and software components provided by third parties under their own licences. Some of those licences impose use restrictions that apply to you when you use the corresponding feature. The applicable notices are set out in the Third-Party Licenses document available within the App, which forms part of these Terms with respect to those components.

3. Use License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service for your personal use and for your own internal business or professional purposes. You may not resell the Service, or offer access to it or to its output as a service to third parties, without our prior written consent. Use of the Service within an organization is also subject to Section 10.

3a. Platform-Specific Terms

The Service is available on iOS and macOS. Extensions such as the Widget and Keyboard extension are subject to the same Terms. Your use of the Service on any platform or extension constitutes acceptance of these Terms for that platform. Some features may vary by platform due to technical limitations.

3b. Subscription and In-App Purchases

Some features require a paid subscription or prepaid credits. Purchases made inside the App are billed by Apple through the App Store. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan. Where a free introductory trial is offered, the subscription converts to the paid plan at the end of the trial unless cancelled before then. You can manage, change, or cancel your subscription at any time after purchase: on iPhone or iPad, in Settings > [your name] > Subscriptions; on Mac, in the App Store under your account's Subscriptions settings. Refunds for App Store purchases are handled by Apple according to its payment and refund policies. Prepaid credits are consumed as you use paid features, do not expire, and are not exchangeable for cash except where required by law. The App records your credit balance on your device. Because the App Store does not restore consumable purchases, a balance may not be recoverable if you erase or replace your device.

Live interpretation, where available, is charged by connected time rather than per request. The App pays for each 15-second interval in advance from your plan allowance or prepaid credits before that interval begins, and a partly used interval is charged in full. If your remaining allowance and credits cannot pay for the next interval, the session stops at that point. The App shows your usage as a share of your allowance.

3c. Apple Standard End User License Agreement (EULA)

These Terms supplement and incorporate the Apple Licensed Application End User License Agreement ("Standard EULA"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. To the extent these Terms conflict with the Standard EULA, the Standard EULA shall control for your use of the Service on Apple platforms, except where these Terms grant you broader rights.

3d. Web Checkout (where offered)

In some regions and versions of the App, we may offer an optional web checkout operated by Stripe as an alternative to the App Store. Where that option is offered, purchases made through it are billed by us via Stripe, are subject to the pricing, renewal, and cancellation terms shown at checkout and in the Specified Commercial Transactions Act disclosure on our website, and are refundable only as stated there or as required by mandatory law. Entitlements bought through web checkout may need to be linked to the App as described in the checkout flow. Apple is not a party to web checkout purchases and does not provide refunds for them.

3e. Lifetime Offline Unlock (one-time purchase)

Where offered, the Lifetime Offline Unlock is a one-time, non-consumable purchase that grants you a perpetual, worldwide, non-exclusive, non-transferable licence to use the App's on-device translation, on-device speech recognition and on-device speech synthesis features without a subscription and without per-use metering, on the Apple ID used for the purchase and on devices you own or control, subject to the Standard EULA in Section 3c.

What it includes. The unlock applies only to features that run entirely on your device. It does not include, and confers no rights to, features that call our servers or third-party cloud services, including cloud translation models, cloud speech recognition, cloud text-to-speech, cloud-assisted layout-preserving document translation, and cloud image or OCR translation. Those remain available under a separate subscription or prepaid credits.

What "lifetime" means. "Lifetime" and "perpetual" mean for as long as we make the App available on the Apple platform on which you purchased it, and not longer. They do not oblige us to distribute the App indefinitely, to support any particular operating system version or device, or to preserve any individual model. If we discontinue the App on a platform, your licence continues for any copy already installed on your device for as long as it functions, but we are not obliged to provide further updates, downloads or support.

Models may change. On-device capability is delivered through machine-learning models supplied by third parties under the licences described in Section 2a. If a licensor changes or withdraws its terms, if a licence is found to restrict the use we make of a model, or if an operating system or hardware change makes a model unusable, we may remove or replace that model. Where we do so we will use reasonable efforts to provide on-device capability of a broadly comparable kind, but we do not warrant that any specific model, language pair, or level of quality will remain available.

Downloads and hosting. Some models are downloaded after installation. We will use reasonable efforts to keep those downloads available, but the unlock is a licence to use the on-device features, not a commitment to operate download infrastructure for any particular period. Once a model is installed on your device, its operation does not depend on us.

Refunds. Purchases made through the App Store are handled by Apple as described in Sections 3b and 9a. Purchases made through web checkout are handled by us as described in Section 3d.

Termination. Section 5 does not permit us to revoke the Lifetime Offline Unlock except where you are in material breach of these Terms. Nothing in this Section limits rights that consumer protection law grants you and that cannot be waived by contract.

4. Prohibited Uses

You may use the Service only for lawful purposes and in accordance with Terms. You agree not to use the Service:

In any way that violates any applicable national or international law or regulation.

For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.

To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.

To impersonate or attempt to impersonate Translate Blue, a Translate Blue employee, another user, or any other person or entity.

In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.

To reverse engineer, extract, or redistribute the machine-learning models bundled with or downloaded by the Service, except as their respective licences permit.

4a. Protection of the Service and Its Internals

The design, source code, models and model configurations, prompts, processing pipelines, routing logic, quality thresholds, server endpoints, credentials, and other non-public details of how the Service works ("Service Internals") are our confidential information and trade secrets, and are a core part of the value of the Service. You agree that you will not, and will not help or permit anyone else to:

(a) decompile, disassemble, decrypt, reverse engineer, or otherwise analyze the App or its bundled resources in order to derive source code, model weights, prompts, configurations, algorithms, or other Service Internals;

(b) intercept, monitor, record, or analyze the App's network traffic, or extract any API key, token, endpoint, or request format used by the App, or use any of them outside the App;

(c) access the Service or the servers and third-party services it uses by automated means or through any client other than the App, or circumvent or interfere with usage metering, credit consumption, plan or feature restrictions, rate limits, advertising, or any other technical protection;

(d) systematically query, measure, or collect the Service's output in bulk in order to build, train, evaluate, or improve a competing product or service or any machine-learning model;

(e) publish, disclose, or share with any third party, by any means, Service Internals obtained through any of the activities above or otherwise not made public by us; or

(f) copy, modify, or create derivative works of the App, or use the App or any Service Internals to develop or offer a competing product or service.

Any breach of this Section is a material breach of these Terms. In addition to suspending or terminating your access under Section 5 (including, under Section 3e, the Lifetime Offline Unlock), we may seek an injunction, the removal of disclosed material, and compensation for the damage caused, to the extent permitted by applicable law.

This Section does not restrict: (i) any activity that applicable law expressly permits notwithstanding a contractual restriction; (ii) your rights under the open-source and other licences of third-party components listed in the Third-Party Licenses document referred to in Section 2a, with respect to those components; (iii) your use of Your Content and the output you obtain from your ordinary use of the Service; (iv) ordinary reviews, opinions, and descriptions of the Service based on its publicly visible behaviour; or (v) reporting a suspected security vulnerability to us in confidence at the address in Section 11, provided you do not access data that is not your own or disclose the vulnerability publicly before we have had a reasonable opportunity to fix it.

5. Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately. This Section is subject to Section 3e with respect to the Lifetime Offline Unlock, which we may revoke only where you are in material breach of these Terms.

6. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the extent permitted by applicable law, the Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. Nothing in this Section limits rights that consumer protection law grants you and that cannot be waived by contract.

6a. Accuracy of Translations and AI Output

The Service uses machine translation, speech recognition, and generative AI models. Output may be inaccurate, incomplete, or misleading, and may omit or alter meaning in ways that are not obvious. You are responsible for verifying any output before relying on it.

The Service is not a substitute for a professional human translator or interpreter. Do not rely on the Service alone for any decision in a medical, clinical, legal, financial, immigration, safety-critical, or emergency context. Any feature of the Service that is presented as suited to a particular domain, including any clinical or medical mode, is provided to assist a qualified person and is not a medical device, does not provide medical advice, and must not be used as the sole basis for diagnosis, treatment, or any other clinical decision.

6b. Software Defects and Service Availability

The Service is complex software that depends on machine-learning models, operating-system features, device hardware, and third-party services, and we develop and update it continuously. You acknowledge that the Service may contain minor defects, errors, or bugs; that individual features, models, languages, or language pairs may at times not work, work slowly, or produce degraded results; and that features may be interrupted during maintenance, updates, or outages of the services on which they depend. We do not warrant that the Service will be error-free or uninterrupted, or that every defect will be corrected.

Minor defects and temporary malfunctions of this kind do not by themselves constitute a breach of these Terms, provided that we use reasonable efforts to correct defects we become aware of within a reasonable time, which may be through a future update or by replacing the affected model or feature. Features labelled as beta, preview, experimental, or similar are provided for evaluation and may change or be withdrawn at any time. Any liability we have for defects is subject to Section 7.

If a defect substantially prevents you from using a paid feature you purchased, please contact us at the address in Section 11; for App Store purchases you may also request a refund from Apple. This Section does not limit our liability for wilful misconduct or gross negligence, or rights that mandatory consumer law grants you and that cannot be waived by contract.

6c. AI Chat Assistant

The App includes a chat assistant that generates replies automatically using machine-learning language models, usually running on your device. You are not talking to a person. Replies are produced by a statistical model, not written or reviewed by us, and may be wrong, out of date, incomplete, biased, offensive, or presented with more confidence than is justified. The assistant does not know your circumstances and does not remember earlier conversations unless they are in the current chat. Replies do not represent our views, and we do not endorse them.

Replies are general information only. They are not medical, mental-health, legal, financial, tax, immigration, or other professional advice, and must not be used as the basis for decisions in those areas. If you need such advice, consult a qualified professional. The assistant is not an emergency or crisis service: if you or someone else may be in danger, or you are having thoughts of harming yourself, contact your local emergency number or a crisis line immediately.

You are responsible for what you ask the assistant, for checking its replies before you rely on or share them, and for how you use them. Replies may resemble existing material, and we do not warrant that a reply is original or free of third-party rights; check before you publish or use a reply commercially. Do not use the assistant to make statements about real people that you have not verified. You must not use the assistant to seek or produce content that is illegal, sexually exploits minors, harasses, threatens, or defames anyone, or gives instructions for violence, self-harm, weapons, or other serious harm, and you must not try to bypass its safety measures. Using the assistant is also subject to the use restrictions in the licences of its models (Section 2a).

The assistant may suggest actions within the App, such as starting a translation or opening a settings screen. An action is carried out only after you confirm it. If you are under 18, you should use the assistant only with the knowledge of a parent or guardian.

Any liability we have in connection with the assistant is subject to Sections 6, 6a, and 7.

7. Limitation of Liability

To the extent permitted by applicable law, Translate Blue and its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; or (iv) unauthorized access, use or alteration of your transmissions or content. Our aggregate liability for all claims arising out of or relating to the Service shall not exceed the total amount you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim. These limitations do not apply to liability arising from our wilful misconduct or gross negligence, and, where you are a consumer, do not exclude liability that the Consumer Contract Act of Japan or other mandatory law does not allow to be excluded.

8. Indemnification

You agree to defend, indemnify and hold harmless Translate Blue and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Your Content (Section 19) that you submit to the Service.

9. Modifications

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect, in the manner described in Section 17. What constitutes a material change will be determined at our sole discretion. Continued use of the Service after the effective date of a revision constitutes acceptance of the revised Terms.

9a. Refund and Apple Information Sharing

If an end user requests a refund for an in-app purchase, we may share relevant details with Apple regarding their in-app purchase activity. This may include app usage duration, an anonymous account identifier, the total amount spent, and the total amount refunded.

10. Use Within Organizations

10a. Organization Deployment

An organization may make the Service available to its employees, contractors, and authorized agents for the organization's internal business purposes, including by installing it on devices the organization owns or manages. Paid features are available to each user through the subscription, credits, or one-time purchase associated with the Apple ID used on that device, on the same terms as for any other user. We do not offer a separate organization plan or individually negotiated terms.

10b. MDM Deployment

Organizations may deploy the Service to managed devices via Mobile Device Management (MDM) systems. The organization is responsible for configuring Managed App Configuration policies in accordance with its own security and compliance requirements. The organization's MDM administrator may centrally provision API keys, enforce offline-only mode, restrict available translation engines, and set default language pairs.

10c. Organization Responsibilities

An organization that deploys the Service is responsible for: (a) ensuring that its users comply with these Terms; (b) managing API keys and credentials distributed via MDM; (c) configuring appropriate security policies for its deployment; and (d) maintaining the confidentiality of any centrally managed API keys.

10d. Data Processing Agreement

An organization that deploys the Service may request our standard Data Processing Agreement (DPA), which formalizes the data handling commitments described in our Privacy Policy, by contacting TranslateBlue@proton.me. We do not negotiate customer-specific DPA terms.

11. Contact Us

If you have any questions about these Terms, please contact us at TranslateBlue@proton.me. Our website is https://translate-blue-website.vercel.app.

12. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13. No Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.

14. Assignment

You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, or by operation of law.

15. Force Majeure

We shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labour disputes, governmental action, power or network failures, or the failure or unavailability of third-party services on which the Service depends.

16. Entire Agreement

These Terms, together with the Privacy Policy and the Third-Party Licenses document referred to in Section 2a, constitute the entire agreement between you and Translate Blue regarding the Service and supersede any prior agreements.

17. Notices

We will provide notices required under these Terms by displaying them within the App or by posting them on the website identified in Section 11. Notices are effective when displayed or posted.

18. Export Control and Sanctions

You may not use the Service in violation of applicable export control or economic sanctions laws, and you represent that you are not located in, or a resident of, any territory subject to comprehensive sanctions, and that you are not listed on any applicable restricted-party list.

19. Your Content

"Your Content" means the text, audio, images, documents, glossaries, and other material you submit to or process through the Service. As between you and us, you retain all rights in Your Content. You grant us a limited licence to process Your Content solely to provide the Service to you, including transmitting it to the third-party providers described in the Privacy Policy where you use a feature that requires them. This licence ends when the processing is complete. We do not use Your Content to train or improve any machine-learning model.

20. Accounts

Some features, including web checkout where offered and the entitlements associated with it, require an account. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your credentials, and for all activity under your account. Notify us promptly at the contact address in Section 11 if you believe your account has been used without your authorisation.

21. Organization-Provided API Keys

The App does not ask you to enter your own API keys; cloud features run on our credentials and are paid for with in-app credits or a subscription. If your organization supplies credentials for third-party translation, speech, or AI providers through Managed App Configuration, the organization's use of that provider is governed by its own agreement with them, the organization is responsible for complying with their terms and for all charges they bill, and we are not a party to that relationship. The App reads such credentials from Managed App Configuration each time it needs them and does not copy them into its own storage, as described in the Privacy Policy.

22. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan, without regard to its conflict-of-laws rules. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance. If you are a consumer, nothing in this Section deprives you of the protection of mandatory consumer laws of the country in which you reside, or of the right to bring proceedings in the courts of that country where those laws so provide.

These Terms were last updated on October 1, 2026 and take effect on that date.
